Claim
A lawsuit was filed against the insured, a construction and design company. The suit alleged deficiencies in the work the insured performed on a historic commercial building. As an historic building, renovations are required to adhere to strict guidelines. Deficiencies cited included the building’s siding, which had begun to bow, and incorrectly painted windowsills, which the plaintiffs maintain were supposed to be ordered in a specified color as a manufacturer provided finish, not painted. The case was settled during mediation.
